the Crime of Incitement in the Field of Journalism in Islamic Jurisprudence and the Algerian Penal Code
Abstract
Journalism is considered an essential source in obtaining information and searching for it and enabling the public to see new news in various walks of life, and it can also contribute to building their ideas and directing their will, and thus it is considered one of the factors affecting the recipient’s psyche and directing it to the destination that it wants, either directly. Or indirectly, it may affect its audience in a positive way and it is considered an effective means in raising awareness and building the nation, taking into account the provisions and principles of Islamic Sharia and the law alike, and it may negatively affect them, and the case is no longer limited to crimes affecting the state and crimes of defamation and insult, but beyond the work of journalism. It is more dangerous than that, as it has become fueling and indicating the commission of crimes, especially in times of crises and unrest that countries sometimes experience, and therefore the crime of incitement in the current era is one of the most serious crimes. This is what we will try to shed light on through the two following researches. The first is devoted to a concept of the crime of incitement in general, and the second will show the images and methods of the crime and the prescribed punishment for it.
