Starting from a critical analysis of the legal issues related to BCI applications, the paper aims to provide the explanation of a prototype of an evaluation and measurement tool for legal compliance of BCI products, in order to ensure the compliance by design of the BCI products with the current legislation and the protection of human rights. Therefore, the research work will briefly illustrate the main legal issues of interest and then the related parts of the tool prototype.
