This article, explanatory and documentary research fruit, sought to carry out an empirical research review in sociology of the courts and prepare an expository framework of the main research on this topic in Brazil and Portugal. The main objective was to discuss the method of the main research on the justice system in both countries and some of the characteristics of the organs that comprise it. The findings pointed out that research on the sociology of the courts reviewed here, bring, indeed, much information about the judiciary, its composition, ideological orientation, among others, but warned that any foray into this field can be complete without incorporating qualitative analyzes.
