During the past century the birth and formation of the so-called "Modern State" has monopolized the attention of a great historiography sector. At the same time, over the past thirty years a tendency in political and legal history that has acquired more and more supporters criticises the utilization of the "State" concept regarding the Old Regime's societies. In this paper, through the study of the constitutional history of the kingdom of Navarre during the XVIIIth century, the author participates in the debate trying to conciliate the different positions in order to clarify the historiography's panorama according to the modern hermeneutic principles, specially as developed since Emilio Betti's contributions.
