El derecho humano al medio ambiente y su protección efectiva

Abstract

The human right to enviroment acknowledged by the Aarhus Convention clarifies its acknowledgment also at european, spanish and catalan level either as a subjective legal situation (right or collective legitimate interest) or as objective (enviromental legislation). The most important objective of the already said Convention is to confer a real and effective protection to the human right of enviroment. Even though this objective was enshrined in the european, spanish and catalan legislation, an important development in normative and case law is necessary and urgent.,
