Economic effectiveness and a quality of a subject of public procurement

Economic efficiency and a quality of a contract’s subject are two new rules introduced by the legislator to the Act of 11 September 2019 on Public Procurement Law. According to these rules, the contracting authority’s duty is not only to ensure that public funds are spent economically, but also to look for an offer that represents the best ratio of a quality of a subject of a contract to funds held by the contracting authority. However, this does not mean that the subject must be of the highest quality, but its quality must be proportional to the financial resources available to the contracting authority. Efficiency and quality must work together to ensure the correct implementation of the subject of the contract. Hence, it is important to define these concepts.
