Notes on the legal position of women during the Franco Regime
Abstract
This paper examines the position of women during the Franco regime from a legal perspective. The article is divided into four sections which cover the chronological evolution of this perspective. The first section offers a summary of the legal advances achieved by women during the Second Republic. The second section examines the position of women during the Franco regime from an ideological and doctrinal perspective. After considering these precedents, the third section analyses the legal position of women from the perspective of four major fields of the law: Family Law, Penal Law, Education Law and Employment Law, tracing its evolution during the dictatorship. Lastly, as a corollary, the author discusses developments from the Constitution of 1978 up to the most recent legislation in the field of equal rights and the rights of women.
