LEGISLATION OF EMPEROR JUSTINIAN I ON MONASTICISM (PART 1): NOVELLAS V AND LXXIX

Abstract

The publication contains Russian translation of two constitutions of the EmperorJustinian I regulating issues of monastic life. The 5th novella defines the procedure of found-ing a new monastery, rules of becoming a cloisterer (including topics of bequest and inheri-tance), formulates some inner regulations and establishes punishments for infringers ofmonastic discipline. The 79th novella spreads over monks principles and procedure of theepiscopal trial (episcopalis audientia), which was the most significant institution of the inde-pendent ecclesiastical jurisdiction. The translation is accompanied with a legal as well asphilological comment.
