Principles forensic expertise reduced general working ability
Abstract
In practice, the concept of general working ability is often equated with the lifestyle activity. It is customary that the general ability involves generalized possibility of performing certain tasks in the labour market that are not related to the candidate's profession and which are in accordance with his mental and physical abilities. However, when it comes to forensic expertise of general working ability, in the context of compensation for material damage suffered, the notion of general working ability has a completely different meaning. In this sense, the main fact is that expertise of reduced general working ability is carried out in relation to the tasks performed by the damaged person prior to the incident - of which he/ she realized profits which were not related to his profession. Only in this way the suffered material damage can be adequately determined. It starts from the premise that damaged person suffered measurable material damage as a consequence of the incident (decrease or loss of earning). In addition, the aim of this paper is to specify general working ability, differentiating the relevant concepts and indicate the specificity of forensic expertise in this area. The process of expertise of reduced general working ability is identical to the already established principles of professional expertise of reduced working ability, and thus the procedure of expertise of reduced general working ability will not be elaborated in this paper The process expertise reduced general working ability is identical to the already established principles of professional expertise reduced working ability, and expertise in working procedure reduced general working ability will not elaborate.
