La motivación en la contratación pública: análisis de la reciente jurisprudencia europea y española

Abstract

This paper constitutes a jurisprudential study on motivación in public procurement. The statement of reasons is an essential requirement, whose lack leads to the annulment of the challenged act, although its effects are usually limited to the retroaction ot the procedure so as to carry out a sufficient reasoning. The motivation can be based on the technical reports that support the administrative resolution.
