Formação Social da “Consciência Jurídica”: observações sobre a conexão entre intersubjetividade e normatividade em Kant e Fichte
Abstract
This paper intends to investigate the relation between intersubjectivity and normativity in Kant´s and Fichte´s philosophies of right. Firstly, I discuss the significance of Kant´s legal theory in a systematic interpretation of the critical philosophy. Secondly, the task is to delineate the intersubjective structure underlying Kant´s moral foundation of law. Thirdly, I propose an analysis of the transition from private right into the public sphere as an intersubjective development of the “juridical consciousness”. The fourth part focuses on Fichte´s appeal to mutual recognition in order to ground the applicability of the interpersonal rationality implicit in Kant´s moral account of right. Finally I discuss Fichte´s idea of hypothetical validity of right in order to point out the difficulties of Fichte´s model and to indicate the ethical potentialities of a juridical consciousness that is intersubjectively anchored.
