CRIMINAL AND JURIDICAL PROTECTION THE RIGHT OF INTELLECTUAL PROPERTY

The work is dedicated to the issue of criminal and juridical protection of intellectual property in our law. In the first part of his work, the author points out that intellectual property stealing in the world has reached epidemic dimensions, and for this reason a different approach to protecting intellectual property at international level had to be undertaken. In that sense, under the influence of developed countries, an Agreement on Trade Aspects of Intellectual Property Law has been adopted and it obliges all the countries, both the members of the World Trade Organization and those intending to join it, to provide suitable protection of the right of intellectual property for national legislation which also includes criminal and juridical protection. In accordance with the juridical competence, the Republic of Serbia has, in its Criminal Code dedicated a separate chapter to criminal acts of intellectual property rights infraction, which is the subject the author especially deals with. In his concluding thoughts the author makes a constatation that the Criminal Code of the Republic of Serbia has been brought according to TRIPS regulations. In that way, for the first time in our country, intellectual property is treated from the criminal and juridical point of view, and the results can already be seen. However, in his conclusion, the author points out unequal treatment of the right to intellectual property in criminal and juridical sense and suggests of changes.
