Abstract

The creation of intellectual property in research and development institution has its peculiarities, which in our opinion the current legislation does not fully take into account. The article deals with the peculiarities of the existing as well as the proposed legal regulation in relation to public universities and the Slovak Academy of Sciences, including its organizations in the context of technology transfer. It also deals with the peculiarities of the employment regime in the private and public spheres, and the remuneration of creators. It compares the regulation of school works and discusses the absence of regulation of the school regime in the field of industrial rights.
