The literature of Borges and the implementation of legal knowledge: an epistemological analysis of the law

This paper has the purpose of examining the constitution and implementation of legal epistemology, based on theoretical contributions that analyze the connection between law and literature. The study is accomplished mainly based on the conceptual materials found in the work of Jorge Luis Borges. The bond between the two areas creates a range of study that makes it possible to examine the contextual characteristic of the law. To do so, and to offer a specific analysis, we perform a literary reading of the concept “paradigm”, as developed by Thomas Kuhn. The theoretical instruments and categories from Borges’s literature allow a legal philosophical study on the idea of paradigm for the law. These dialogues and theoretical interchanges are relevant to shed light on the complexity of the legal knowledge.
