PRECONDITIONS AND CRITERIONS OF FORMING SUPERVISORY COUNSILS AT MUNICIPAL ENTERPRISES IN UKRAINE

In this scientific paper, by analyzing the research of Ukrainian and foreign authors and changing of legal acts, identified that functions of state regulation on municipal services marketplace are performing by Ukraine’s Antimonopoly Committee, Ukraine’s National Commission of state regulation in energetic and municipal services and departments of local governments. Effective state regulation for municipal enterprises which are identify as natural monopolists is offered by creating supervisory councils, their principals should be independence, competence and auditing. Six criterions of forming supervisory councils at municipal enterprises by those principals and list of information for public disclosure are submitted by the author. Creation of supervisory councils is the main lever of control by agreements implementation, in particular state-private partnership contracts on municipal services marketplace. Exactly in this way, we can provide comprehensive monitoring agreements implementation in two directions, at first, for the needs of municipal service users, also for private investors.
